Our expertise in this area includes public concessions and PPPs, negotiation and management of public contracts and public procurement. We also represent our clients in major disputes involving public law.
We have extensive experience representing clients in relation to proceedings before the Federal Court of Accounts (TCU) and other control institutions and we are recognised in the marketplace for our expertise in this area. In Brazil, projects involving public resources are often monitored and audited by internal and external control institutions. During the auditing processes of these institutions, issues are often raised that can impact or even make unviable a contract or an entire project. Therefore, understanding how such institutions operate and what effect their actions can have on each type of project is fundamental in order to efficiently manage public projects.
Based on our deep understanding of the decisions of the control institutions, as well as related laws and procedures, we are able to provide clients with tailored advice for their specific situation. Aside from the Federal Court of Accounts (TCU) we also act for clients in proceedings before state and municipal accounting courts as well as other control institutions such as the Office of the Comptroller General (CGU).
Where a decision of the control institutions appears to be mistaken or overreach its competency, we often assist our clients with administrative appeals or judicial review of the decisions. We have extensive experience in representing clients in leading judicial and constitutional actions of this nature, including before the Supreme Federal Court.
